D&A Licensing Update

D&A Physical Plant Standards Published
The Division of Drug and Alcohol Program Licensure published a Licensing Alert on March 8 along with a copy of the new physical plant standards for drug and alcohol facilities. These regulations became effective March 2. They apply immediately to any facility licensed after March 2. All facilities licensed prior to March 2 must be in complete compliance with the regulations by December 2. All inpatient non-hospital residential treatment and rehabilitation, inpatient non-hospital detoxification, inpatient non-hospital transitional living, and psychiatric hospital activities must immediately submit blueprints or a diagram with designated bedrooms and dimensions, identifying the number of single beds and bunk beds in each room, as well as the activity for each bed used; e. g., detoxification, rehabilitation. Providers that have not complied with this request will be contacted directly. An extension will be given upon the explanation of the reason for the delay and a date of expected submission.

Methadone Regulations Moving to the Front Burner
Cheryl Williams, Division of Drug and Alcohol Program Licensure, reported at the PCPA D&A Committee meeting on March 19 that Methadone regulations are top priority. Williams added that the regulations must be published in final no later than the end of August. The latest draft of the regulations is expected to be submitted to the Independent Regulatory Review Commission (IRRC) and available for review in the very near future. It appears that the issue of physician hours will be of most concern to PCPA members. PCPA will be working with members and meeting with IRRC to assure that these concerns and others are adequately addressed.

D&A Prevention Regulations to be Rescinded
As expected, the prevention regulations rescission will be published as final in the next few months. The rescission deletes the regulations relating to approval of prevention and intervention activities. The final decision regarding who will have oversight of the new process has not yet been determined.
