Chapter 3800 Draft Licensing Measurement Instrument Available

The Child Residential and Day Treatment Regulations, PA Code 55, Chapter 3800, were published as final in the Pennsylvania Bulletin on June 26. A Licensing Measurement Instrument has been drafted by the Department of Public Welfare, designed to measure compliance with the Chapter 3800 Regulations. Ms. Karen Kroh, Office of Policy Development, Department of Public Welfare, will accept comments on the draft instrument until July 28.

The PCPA Children's Residential Work Group will be meeting on July 20 to review the draft instrument and make comments. Members interested in attending the meeting should contact Kris Ericson. Copies of the draft instrument are available via mail from the Association.

As of October 25, all facilities covered by the scope of the new regulations must meet the new regulations. Inspections occurring on or after October 25, including complaint and provisional follow-up inspections, will be conducted using this draft measurement instrument. Inspections occurring prior to October 25 will be conducted using the regulations in effect at the time of the inspection. Training for providers on the new regulations is anticipated in late September and early October.
