Consent and Confidentiality Manual Revised
February 3, 2006

The Juvenile Law Center has published a new edition of the Consent to Treatment and Confidentiality Provisions Affecting Minors in Pennsylvania. The second edition of the manual is designed to provide guidance to health care and behavioral health providers who directly treat minors, as well as to child-serving professionals who assist youth in obtaining health care. The manual provides a comprehensive overview of the laws and regulations at the state and federal levels. These laws govern the ability of minors to consent to their own medical, mental health, and substance abuse testing and treatment as compared to situations requiring the consent of the minor’s parent or legal guardian.

Since the publication of the first edition two major changes have occurred; the implementation of the Health Insurance Portability and Accountability Act of 1996 and, most recently, Pennsylvania’s amended Minor’s Consent Act of 2005. Both of these are covered in the new edition of the manual. This important document is available for viewing and download from the Juvenile Law Center web site, www.jlc.org.
