OCYF Implementation of Act 109

The Office of Children, Youth and Families (OCYF) has issued a Special Transmittal providing information and guidance to counties and their contracted providers regarding Act 109 of 2008. This law, signed by the governor on October 9, amends the statute known as The Juvenile Act. This law accomplishes two primary purposes:

  1. It ensures that agencies provide to resource parents (foster and kinship families) an opportunity and format for sharing valuable input about the child with the court, and
  2. It ensures that self-incriminating information obtained from a child in the course of an assessment or screening may not be used as evidence that a delinquent or criminal act occurred.
