Prone Restraint Ban for Chapter 3800 Programs

On December 19 the Department of Public Welfare (DPW) issued a statement of policy regarding prone restraints prior to publication in the Pennsylvania Bulletin. This statement of policy relates to programs approved under Title 55, Chapter 3800, and includes child residential programs, day treatment, and state youth detention and youth forestry programs. The effective date of the statement of policy is June 21, 2010, to allow time for implementation.

In addition to the policy bulletin that discusses strategies and practices for reducing and eliminating restraints, the Alternatives to Coercive Techniques (ACT) core competencies document has been distributed. This document was developed in partnership with the state ACT work group including provider representatives.  The core competencies present basic practice ideals that apply when working with children and youth in all settings.  DPW program offices have established a point of contact that is listed below. Questions regarding this protocol can also be directed to the appropriate DPW regional office.  Regional offices can also discuss appropriate restraint holds and restraint reduction strategies.
