Comments Requested on Community-Based Waiver Services

The Centers for Medicare and Medicaid Services (CMS) has published proposed rule changes to regulations implementing Medicaid home and community-based services waivers under Section 1915(c) of the Social Security Act. Public comments are due to CMS by 5:00 p.m. on June 14. Please share comments with PCPA no later than June 13 to be included in the association response. Comments should be sent to Linda Drummond. A copy of the Federal Register proposed rule change is available.

The main components of the changes include:

  • Allowing states to develop a single section 1915(c) wavier serving three target groups: aged or disabled or both, mentally retarded/intellectually disabled or developmentally disabled or both, and mentally ill;
  • Expectations for person-centered plans;
  • Types of living arrangements that are acceptable (non-segregated or institutional or cluster residences on a campus are not allowed);
  • Assisted living is an option if meets certain independent type criteria; and
  • Home and community-based settings must be integrated in the community, provide meaningful access to the community and activities, and offer choice about providers and daily life activities.
