Annual DRA Attestation Due
January 26, 2009

A recent Medical Assistance (MA) Remittance Advice Alert/PROMISe Banner Page announcement reminded providers and managed care organizations (MCO) to submit the Attestation of Compliance with Section 6032 of the Federal Deficit Reduction Act (DRA). Section 6032 requires employee education about false claims recovery for entities that annually receive or make payment of at least $5 million from the MA program. Only the actual payment amounts received from MA are counted toward the threshold amount, not the amounts that were billed. Also, patient pay amounts and amounts received from a Medicaid MCO do notcount toward the threshold. Attestation statements are due annually by December 31. Affected entities that have not already done so are requested to submit completed attestation statements to the Bureau of Program Integrity no later than February 15. The statement and more information about False Claims Recovery Education and DRA requirements is available in Medical Assistance Bulletin 99-07-13, Updated Regarding False Claims Provisions of Deficit Reduction Act of 2005 - Employee Education About False Claims Recovery (sic), issued September 7, 2007 (www.dpw.state.pa.us/PubsFormsReports/NewslettersBulletins/003673169.aspx?BulletinDetailId=4091).
