MR Bulletin On “30 Hour Rule” Issued
October 23, 2003

The state’s Office of Mental Retardation is issuing a new Mental Retardation Bulletin to clarify the “30 Hour Rule.” This rule states that residential homes for three or fewer people with mental retardation who are 18 years of age or older and who need a yearly average of 30 hours or less of direct staff contact per week, per home do not have to be licensed.

Provider agencies and families have asked a variety of questions. Addressed are: definitions of mental health establishment, private homes, and relative. The bulletin is available from this link. Contact Linda Drummond at PCPA with any questions.
