ODP Rate Appeal
The deadline is early next week to file appeals to the Office of Developmental Programs (ODP) for residential-eligible and transportation services cost-based rates. This is 33 days from the date on providers’ final rate notification letters, which were issued on November 7 for the 2014/15 fiscal year.

The Department of Human Services’ settlement agreement was reached on October 28 with providers, which will lead to changes in Chapter 51 policies on vacancy and retention factor that have not yet been developed by the ODP. Therefore, providers that need to file an appeal should follow the information provided in the final rate notice. This will preserve the providers’ rights, and when ODP issues its new policies, providers may withdraw their appeals if they accept the new policy addendum.

ODP Updates
The Office of Developmental Programs (ODP) has released the following information:

  • Informational Packet #091-14: Agency With Choice Financial Management Services Wage Ranges and Benefit Allowance and Corresponding Department Established Fees for Specific Participant Directed Services Effective January 1, 2015.
  • Announcement #092-14: ODP Home and Community Services Information System (HCSIS) Services and Supports Directory (SSD) Reminder. Providers of services to individuals enrolled in the ODP waivers must sign-up for services they will deliver in FY 2015/16 in the SSD by December 31. Instructions are provided on end-date services and service locations.

PIAT Survey
The Pennsylvania Initiative on Assistive Technology (PIAT) at the Temple University Institute on Disabilities is developing a new state plan for assistive technology. They are requesting stakeholder input for this plan with a brief survey. Please complete the survey by January 15, 2015.

Developmental Disabilities Council Survey
The Pennsylvania Developmental Disabilities Council requests stakeholder input into its 2014 goals and satisfaction with council-supported activities. The five-question satisfaction survey is available online.

ACA Survey
The American Network of Community Options and Resources (ANCOR), the national association of which RCPA is a member, is asking agencies supporting people with disabilities to complete a survey to determine the status of community service providers’ ability to meet requirements of the Affordable Care Act (ACA).

The ACA employer mandate/employer penalty, originally set to being in 2014, is delayed until 2015/16. The employer mandate is a requirement that all businesses with over 50 full-time equivalent (FTEs) employees provide health insurance for full-time employees or pay a per month "Employer Shared Responsibility Payment" on its federal tax return.

Small businesses with 50-99 FTEs will need to start insuring workers by 2016. Those with 100 or more FTEs must start providing health benefits to at least 70 percent of its FTEs by 2015 and 95 percent by 2016. Health care tax credits have been retroactively available to small businesses with 25 or less FTEs since 2010.

PACA MH/DS Hires New Director
The Pennsylvania Association of County Administrators of Mental Health and Developmental Services (PACA MH/DS) has announced a new executive director, Lucy Kitner. She has a background in association management including working at the Pennsylvania Medical Society, York Bar Association, and Ohio Medical Association.

ODP Updates
The Office of Developmental Programs (ODP) has released the following information.

  • Announcement #089-14: ODP Announces New Professional Training Vendor. Effective January 1, 2015 the new vendor for ODP Consulting will be The Columbus Organization.
  • Announcement #090-14: Supplemental Security Income (SSI) Increase for Calendar Year 2015. Effective January 2015, the monthly SSI maximum will be $733 for an eligible individual. There is no anticipated increase in the State Supplementary Payment for 2015.
