CPS Retainer Payment Update

ODP Announcement 20-074 provides updated information regarding CPS Retainer payments to providers. Retainer payments for CPS providers for 120 days (March 1 through June 30, 2020) were funded through the CARES Act. Each provider’s retainer payment has been calculated at 75% of average monthly billing for 7/1/19–2/29/2020 and has been distributed through a gross adjustment.

Funds received for the period of March through June must be expended by November 30, 2020 or returned to the commonwealth. Additionally, these funds must be used for COVID-19 related expenses. Providers will be expected to provide a report on expenditures.

For the period of July 1 through September 30, 2020, ID/A Waiver funds will be used to make retainer payments to CPS providers. The retainer payment for the period of July 1 through September 30, 2020 will be calculated as follows:

  • July and August 2020: 50% of average monthly billing for 7/1/19–2/29/2020 if the facility is located in a county that is in a red or yellow phase; 25% of average monthly billing for 7/1/19–2/29/2020 if the facility is located in a county that is in the green phase.
  • September 2020: 25% average monthly billing for 7/1/19-2/29/2020 regardless of the phase of the county where the facility is located. ODP will evaluate in August if there is a need for retainer payments for additional periods.

The Appendix K amendment approved by the Centers for Medicare and Medicaid services on March 18, 2020, requires ODP to conduct an analysis of any retainer payments made for the period of July 1 through September 30 and reconcile the payments if needed to ensure that no duplicate payments have been made for services rendered. Additional details will be provided by ODP on the payment dates and reconciliation process.
