Appendix K

The Office of Developmental Program (ODP) has shared Final Fee Schedule Rates for Select Services Funded Through ODP’s Waivers and Guidance About Community Participation Support Impacted By the End of Appendix K. The purpose of this communication is to announce that the following Fee Schedule Rates have been published as final in the Pennsylvania Bulletin:

  • Residential Habilitation Needs Group 5 services funded through the Consolidated Waiver;
  • Group Music Therapy, Art Therapy, and Equine Assisted Therapy funded through the Consolidated, Community Living, and Person/Family Directed Support (P/FDS) waivers; and
  • Adoption of the enhanced rates as the fee schedule rates for Community Participation Support (CPS) funded through the Consolidated, Community Living, and P/FDS waivers and Transportation Trip funded through the Consolidated, Community Living, P/FDS and Adult Autism waivers.

This communication also provides guidance about implementing Fee Schedule Rates and procedure codes for Community Participation Support/Day Habilitation teleservices in the Consolidated, Community Living, P/FDS and Adult Autism waivers that become effective November 11, 2023, when Appendix K flexibilities end.

The Office of Developmental Programs (ODP) has informed RCPA that the final rates for services that will be impacted by the ending of Appendix K, which includes CPS, transportation, and Residential Needs Group 5, will be published in the PA Bulletin this weekend. The rates were first published as proposed rates in the Pennsylvania Bulletin, Volume 53, Number 21, on Saturday, May 27, 2023.

In some cases, these rate changes will require a critical revision to Individual Support Plans (ISP). Information regarding implementing Needs Group 5 for individuals served in residential habilitation with exceptional needs is outlined in ODP Announcement 23- 083.

The Office of Developmental Programs (ODP) has shared the announcement Additional Guidance for the End of Appendix K Flexibilities in the Consolidated, Community Living, Person/Family Directed Support (P/FDS) and Adult Autism Waivers. The purpose of the communication is to provide additional guidance on which Appendix K waiver flexibilities have been added to the approved intellectual disability/autism waivers (ID/A), which are the Consolidated, Community Living, and P/FDS Waivers, and the Adult Autism Waiver (AAW), as well as which Appendix K flexibilities will be ending November 11, 2023. ODP Announcement 23-019 is to advise all stakeholders that the COVID-19 PHE is officially ending May 11, 2023. All provisions made under Appendix K will expire on November 11, 2023.

The Office of Developmental Programs (ODP) will release more detailed information regarding transition activities as they develop. A link to the Department of Health and Human Services (HHS) statement is provided here.

Message from the Office of Long-Term Living (OLTL):

This communication is a reminder that the Office of Long-Term Living (OLTL) is allowed to continue available temporary changes to the CHC waiver, OBRA waiver, and the Act 150 Program under Appendix K, Emergency Preparedness and Response, until six months after the end of the federal public health emergency related to COVID-19.

On October 15, 2021, the federal public health emergency was extended by 90 days; however, it’s possible the federal government will decide to extend the emergency further. Please visit this public health emergency website to see the current and future public health emergency declarations related to COVID-19. OLTL will issue guidance in the future when the Appendix K flexibilities are closer to expiring.
