Heightened Scrutiny

ODP Announcement 23-013 informs all interested parties of the submission of Pennsylvania’s Heightened Scrutiny locations to the Centers for Medicare and Medicaid Services (CMS). The information submitted is available on the Department of Human Services’ (Department) website.

On February 1, 2023, the department submitted all locations identified as requiring a Heightened Scrutiny review by CMS. The information submitted may be viewed at the bottom of this web page. CMS will make final heightened scrutiny review determinations available online. Questions about Heightened Scrutiny or this communication should be sent electronically.

ODP Announcement 22-121 reports that the recording of the presentation provided by the Office of Developmental Programs (ODP) staff during the webinar on December 1, 2022, which was to provide an overview of the heightened scrutiny process and to listen to public comments, is now posted on MyODP.

Public comments are being accepted until 11:59 pm on December 19, 2022. ODP Announcement 21-081 informs providers that the Heightened Scrutiny Onsite Tools for Non-Residential Service Locations has been finalized and posted for stakeholders to view. The Office of Developmental Programs (ODP) is also using this communication to address some of the comments and concerns that were received through public comment.

While the COVID-19 pandemic resulted in significant delays in performing the onsite visits, ODP will now be continuing with the Heightened Scrutiny process for Community Participation Support (CPS) and Day Habilitation service locations to meet the CMS requirement that all waiver providers must be in full compliance with the Home and Community-Based Services (HCBS) Settings Rule no later than March 17, 2023.
